Shipping container permits in Ashe County, NC: the order of calls.

Ashe County lists fourteen land-use ordinances and none of them is a zoning ordinance, yet its building permit rule still stands, with Building Inspections deciding whether that rule reaches a container, and inside West Jefferson, its extraterritorial jurisdiction (ETJ) or Jefferson, the town's zoning desk comes first.

Matching an Ashe County parcel to its first desk

Ashe County's permit checklist puts the towns first: "If you are in the town limits you will need town zoning" before the county issues a building permit. Find your row before you choose a drop spot, since a town line, a flood map or the Park Service boundary can each change where a structure may go.

A parcel can sit in more than one row. We found no posted hours for the Planning Department or Jefferson Town Hall, so call ahead.

Ashe County regulates land one ordinance at a time

Ashe County's Planning Department says it "implements land use regulations through a system of ordinances," and its Land Usage Ordinances page names fourteen: flood damage prevention, manufactured homes, recreational vehicle parks, watershed protection, residential subdivisions, racetracks and motorsport events, communication towers, high impact land uses, adult businesses, voluntary farmland preservation, the county airport, wind energy systems, sign control, and junk materials, junkyards and abandoned motor vehicles. A zoning ordinance is not among them.

So a container meets several narrow questions instead of one zoning answer, each with its own desk. We found no shipping container named in the county code text read for this guide, which takes in the flood and high impact land use chapters in full and sections of the building, planning and airport chapters, so ask Building Inspections how the county treats one.

The hosted code's local legislation is "current through Ord. passed 7-15-24," and on July 15, 2024 the Commissioners pulled proposed Chapter 150 building regulation amendments from a public hearing "for further review," so a Chapter 150 section quoted here could change.

Grayson County, Virginia, regulates land through a zoning ordinance and a zoning administrator instead, as our Grayson County container permit guide lays out, so an answer from one side of the state line does not carry over.

Where town zoning reaches in Ashe County

West Jefferson zones its own ground and an ETJ beyond its limits: Article XVI of its zoning ordinance applies the town's ordinances there "in the same manner as each is now applicable within the corporate limits of the Town of West Jefferson." Sec. 302 holds any building permit until "a zoning permit or special use permit has been issued in writing," and the town's permit form gives "installation of new storage bldg." as an example reason.

Jefferson, the county seat, zones "within the corporate limits of the Town of Jefferson," and its ordinance makes it "unlawful for any person to erect, move, or alter any structures" without a zoning permit. That verb "move" matters for a box that arrives on a truck; whether a delivered container is a structure is the town's reading, not the yard's.

Lansing's 2019 Land Use Plan said the town "has not adopted subdivision regulations, zoning, or an extraterritorial jurisdiction," and that "The County issues building permits for residential and commercial structures within Lansing." The plan speaks as of 2019, so check with Lansing Town Hall, open Tuesday to Thursday, 9:00 to 4:30, and Friday, 9:00 to 12:00.

Building Inspections decides what the county permit rule reaches

Ashe County Building Inspections is the county's permit desk, and its rule stands without a zoning ordinance behind it. Its page says a building permit "is required by the State of North Carolina and must be obtained prior to the construction, reconstruction, alteration, repair, movement to another site, or demolition of any building," and county code Sec. 150.20(B) reaches "any building or other structure."

Whether a delivered container is a building or structure is the department's call, not ours. The page says "In some cases, exemptions from requirements for building permits are applicable," and to contact the department "to determine if a project is exempt." Other approvals, "including but not limited to: floodplain, town zoning, and Environmental Health compliance," may be required before the permit.

The fee schedule effective July 1st, 2026 says "All work started before permitted is subject to double permit fee," so ask before the truck is booked; it has lines for "Garage, Carport, Stor. Bldgs" and "Prefab Utility Bldgs." but no container line that we could find.

The permit counter is on the second floor of the courthouse at 150 Government Circle, Suite 2400, Jefferson, with permitting hours of 8:00 a.m. to 4:30 p.m., Monday through Friday, closed from noon to 1 p.m., and the department "cannot accept credit card payments," so bring cash or a check. Flood hazard land goes past the Planning Director first

In a mapped special flood hazard area, Ashe County's checklist says "All Flood Plain Projects will go through the County Planning Director for approval prior to the issuance of a permit," and the flood chapter names "storage of equipment or materials" among its examples of development. Whether setting a container counts is the county's reading; the Planning Department's page links the flood map and the Floodplain Development Permit form.

Accessory structures in a special flood hazard area must meet every criterion in Sec. 151.41(H), among them no human habitation "(including working, sleeping, living, cooking or restroom areas)," no temperature control, a spot outside the floodway, firm anchoring and service facilities such as electrical installed to the chapter's standard. So expect Planning to ask whether anyone will work inside, how the box will be anchored and where any wiring will sit; on a modified box the shop roughs in electrical only, and a licensed electrician does the final hookup and the inspection.

A temporary non-residential structure in a special flood hazard area needs a removal plan the Floodplain Administrator approves in writing, and under Sec. 151.41(G) its time "may not exceed three months, renewable up to one year." We found no other county rule on temporary structures. The Building Inspections page adds: "(No structures can go in the floodway)."

Ask Planning, 336-846-5957, about any flood or water supply watershed question, town parcels included. What a low, wet spot does to steel, whatever the map says, is the subject of our container in a floodplain answer.

Fifteen feet from Park Service land along the Blue Ridge Parkway

Ashe County's building regulations carry a Parkway rule of their own. Sec. 150.07(A) says "No building or structure which is located upon property which is adjacent to National Park Service property shall be located nearer than 15 feet to the Park Service boundary," and the county's 2022 plan places the Blue Ridge Parkway "along the southern end of the County."

Under Sec. 150.07(B), Building Inspections tells the County Ordinance Administrator about a permit application on such a parcel, and Park Service personnel determine the property line and establish the setback "within 15 days of the application for a building permit," before the permit issues. Proposed Chapter 150 amendments were pulled for further review in July 2024, so confirm the rule when you apply.

The setback changes the order of a container job more than the job. If the county treats the box as a building or structure under that section, let the line be set first, then pick a spot at least 15 feet off it that still gives the truck about 65 feet of straight pull-in for a 20-ft container, about 95 feet for a 40-ft.

Ashe County's barn answer, read with a tree farm in mind

Ashe County Building Inspections answers the barn question in its FAQ: "A building permit is not required for a farm building but an electrical permit is required if there is to be wiring installed." It adds that "The land must be farm sales tax certified or eligible for the present use value program," that the owner must provide a copy of the tax listing showing present use value or the exemption certificate number, and "otherwise a permit is required for the structure."

State law draws its own line. G.S. 143-138(b4) says "Building rules do not apply to (i) farm buildings that are located outside the building-rules jurisdiction of any municipality," and defines a farm building as "any nonresidential building or structure that is used for a bona fide farm purpose as provided in G.S. 160D-903(a)."

A container is not named in the county's answer. Whether one is a farm building, whether the operation is a bona fide farm and whether the parcel sits outside a municipality's building-rules jurisdiction are Building Inspections' calls, so take the tax listing or the exemption number to the counter before you order. Wiring still needs the electrical permit the county names, and a licensed electrician, not the shop, does the final hookup and the inspection.

In West Jefferson's ETJ, G.S. 160D-903(c) says property used for bona fide farm purposes "is exempt from the city's zoning regulation to the same extent bona fide farming activities are exempt from county zoning," and remains under the county's floodplain regulation; the town's Zoning Administrator decides whether a parcel is in that use.
